The monograph is devoted to the development of a modern conceptual idea of the nature, significance and practice of resuming proceedings in view of new and newly discovered circumstances as a form of verification of justice of court decisions that have entered into force and its place in the system of modern Russian criminal and civil proceedings and preparation of proposals on this basis to optimize the norms of criminal procedure and civil procedure legislation necessary for perfect law enforcement activities.
The article analyzes national legislation, acts of the Constitutional Court of the Russian Federation, the Supreme Court of the Russian Federation, the European Court of Human Rights and international law aimed at improving the institution of reopening cases in view of new and newly discovered circumstances, due to the disclosure of legal prerequisites and procedures for initiating proceedings in view of newly opened and new circumstances, determining ways to establish these circumstances, as well as identifying the direction and the formulation of proposals to improve the procedure for the court to consider the resumption of proceedings in view of new and newly discovered circumstances in criminal and civil proceedings.
