The purpose of the study is to identify "pain points" in the relevant legal regulation and to determine ways to eliminate them. The paper shows that the presumption of innocence is blatantly ignored in many norms of the Criminal Code of the RF and the CPC of the RF, and persons who were not found guilty by the court are called "perpetrators of a crime" on a mass scale. It is noted that the CPC RF does not provide effective protection of the rights of persons involved in criminal proceedings. Special attention is paid to the problem of "endless investigation" of a criminal case, the duration of which is limited only by the statute of limitations and provided that the accused does not object to the termination of the criminal case, which leads to violation of the interests of third parties, whose rights continue to be restricted until the investigation is completed. The monograph outlines the main vectors of modernization of the relevant legislation.
