The monograph is devoted to the conceptual foundations of access to justice as a legal phenomenon in the unique meaning of sui generis, which is an integral element of the legal system, a constitutional principle of judicial proceedings and a guarantee of a fair trial. The emphasis is on the social value of the phenomenon of access to justice, guarantees of ensuring access to justice as a fundamental right, which arose as a result of the teleological interpretation by the European Court of Human Rights, the Court of Justice of the European Union, and the Constitutional Court of Ukraine of the provisions on the right to a fair trial and an effective remedy.
