The monograph outlines the concept of improving the modern Russian criminal process as a continental-type proceeding. The inconsistency of the attempt made by the authors of the Code of Criminal Procedure of the Russian Federation to transform the historical form of domestic criminal proceedings into an Anglo-Saxon (pro-American) model of criminal procedural activity, alien to the Russian mentality and traditions, is argued. A balance of public and private interests is put forward as a system-forming factor in the development of criminal procedural legislation, on the basis of which directions for improving pre-trial and judicial proceedings are revealed. Fundamental approaches and solutions are presented as a scientific doctrine for the development of a new Code of Criminal Procedure of the Russian Federation.
